Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Declutr – Photo Cleaner application, website, and related services (collectively, the "Service"). By using Declutr, you agree to these Terms.

1. Eligibility

You must be legally capable of entering into a binding agreement to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Declutr helps users review, organize, favorite, and delete items from their photo library. Certain features may be available only with a paid Premium subscription.

3. Subscriptions and Billing

• Premium features may be offered as monthly or yearly auto-renewing subscriptions.
• Payments are billed by Apple through your App Store account.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period, subject to Apple’s rules.
• You can manage or cancel your subscription through your Apple account settings.

4. User Responsibilities

• You are responsible for reviewing deletion decisions before confirming removal of photos or videos.
• You are responsible for ensuring that you have backups of content you do not wish to lose.
• You agree not to misuse the Service, interfere with its operation, or attempt unauthorized access to our systems.

5. No Guarantee Against Data Loss

Because Declutr helps you manage and delete content from your own photo library, you acknowledge that deletion decisions can have permanent consequences depending on your device and cloud settings. To the maximum extent permitted by law, we are not responsible for data loss resulting from deletion actions you approve.

6. Intellectual Property

The Service, including its software, branding, design, text, and related materials, is owned by or licensed to Declutr and is protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works from the Service.

7. Termination

We may suspend or terminate access to the Service if you violate these Terms, misuse the Service, or if required for legal, technical, or security reasons.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted availability, error-free operation, or that the Service will meet every expectation or recover every unwanted file situation.

9. Limitation of Liability

To the maximum extent permitted by law, Declutr and its affiliates, founders, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, goodwill, or business interruption arising out of or related to your use of the Service.

10. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

11. Governing Terms for Apple Users

If you downloaded the app through Apple’s App Store, you acknowledge that these Terms are between you and Declutr, not Apple, except where Apple’s mandatory terms apply. Apple has no obligation to furnish maintenance or support services for the app beyond what is required by applicable law.
